HOTEL POLICY/HOUSE RULES

SP Real Estate, LLC d.b.a. “The Cottages at Sandy Pines” has established these HOTEL POLICY/HOUSE RULES, and they are incorporated by reference into our reservation agreement with the guest as if set forth at length in that document and are incorporated by reference. We strive to provide our guests with an exceptionally clean, safe, and friendly hotel experience.  The following HOTEL POLICY/HOUSE RULES have been established based on industry standards, management and operational procedures, and our personal experience.  By making a reservation and paying a deposit (or the entire bill, as the case may be), each guest is agreeing to abide and be legally bound by all of our HOTEL POLICY/HOUSE RULES, terms and conditions, and procedures, as amended from time to time.  These HOTEL POLICY/HOUSE RULES are presented here to help promote our guests’ safety and enjoyment and to ensure that each guest is aware of the understandings, responsibilities, and obligations between The Cottages at Sandy Pines and the guest.  Our HOTEL POLICY/HOUSE RULES may change from time to time without advance notice, so please check back often.

 

100% SMOKE-FREE

The Cottages at Sandy Pines has been 100% Smoke-Free since its beginning.  For safety and to assure that our facility is not exposed to items or actions that create an odor which is unhealthy or objectionable to our guests and staff, and that is difficult to remove from the air, carpet, walls, and furniture, we do not permit smoking tobacco, marijuana, illegal drugs, e-cigarettes, vape pens, vaping, cartridges containing the liquid of nicotine, hookahs, incense, cooking, cigars, candle burning, the use or diffusing of patchouli oil or other strong-smelling plant-based essential oils or synthetic products in our facility.

Guests are encouraged to notify us immediately if they smell cigarette, marijuana, or other objectionable odors.   This policy is not intended to stop people from smoking, but to regulate where they smoke and how it affects others.  A Designated Smoking Area is provided outside and away from the building.  Marijuana is prohibited at all times.

If a guest or a guest’s visitor is found to have smoked in our facility, the guest will incur a charge of $250.00 to cover the cost of a deep cleaning, and such fee will be charged to the credit card on record.  This charge is in addition to any actual damages that might have occurred, including but not limited to, cigarette burns, and smoke or fire damage.

 

CANDLE, INCENSE, ESSENTIAL OILS:

Candles, incense, essential oils (diffusing, vaporizing, etc.) are prohibited.  These items and activities will be treated as smoking, a cleaning charge accessed, and the guest may be evicted with no refunds. 

 

NO-COOKING, COOKING APPLIANCES, COMBUSTIBLES, OR FIREWORKS:

The safety of our guests, staff, and this facility is extremely important to us.  Preparation of food in guest rooms by any type of cooking appliances is prohibited.  A minimum fee of $300.00 will be charged for cooking in a room: including, but not limited to hot plates, toaster ovens, water heaters, rice cookers, combustible, open flame, barbecue grill, burners, heating appliance, or any other item intended for or actually used for cooking.  Open fires, flames, or cooking grills, either charcoal or gas, and fireworks are not allowed anywhere on our property. A microwave and coffee pot are available to our guests for their use during their stay in the common kitchenette.

 

GUARANTEED RESERVATIONS:

All reservations must be guaranteed with a valid major credit card.  Guests must be 18 years of age or  older.  We accept Visa, Master Card, American Express, and Discover Card.  We charge the guest’s credit card at the time the guest makes the reservation(s).  The credit card guarantees the reservation(s).  Please make sure to receive a reservation confirmation number when making a reservation.  The Cottages at Sandy Pines is not responsible for weather conditions, personal emergencies, or schedule changes.

 

CHECK-IN TIME:     

Check in time is 4:00 p.m. on the scheduled day of arrival.

 

EARLY CHECK-IN/PRE-REGISTRATION:

Early check-in is offered based on availability.  If a guaranteed check-in for arrival prior to 4 p.m. is required then please contact our staff directly to make arrangements with regard to the reservation(s) and complete any credit card authorization/payment prior to the early arrival (219) 688-7934.

 

CHECK-IN REQUIREMENTS:

Guests must be at least 18 years of age to reserve a room or to check in.  In the interests of security and to prevent fraud, guests may be required to confirm their identity by providing their valid government issued photo identification (State driver’s license, passport, etc.).  A valid credit card in the name of the registered guest is also required.

 

GUEST REGISTRATION:

We require valid contact information from the guest making the reservations including first and last name, address, phone number (to which we may send texts), and signature.  The names of all guests occupying the room must be registered.  Information regarding license plates/car descriptions may also gathered for security.

 

CHECK-OUT/ DEPARTURE TIME:

Room rental period expires at 10:00 a.m.  A fee of $100.00 per half hour beginning at 10:00 a.m. will be charged for late departure.  Guests who fail or refuse to vacate their room by noon on the day of scheduled departure for any reason will incur an additional $250.00 fee (in addition to the late fees that have already accrued) and be subject to forceable removal/eviction by the police. Departure Time is 10 a.m.  Guests should remove all personal property and depart their room by Departure Time.  The facility is video monitored to ensure compliance. A charge may apply for late departure.

 

EARLY DEPARTURE:

Guests who depart our facility prior to their scheduled departure date do not receive a refund for unused time.

 

PAYMENT:

All reservations and registration must be made and guaranteed with a valid major credit card.  We accept Visa, Master Card, American Express, and Discover Card.  All guests are required to have a valid major credit card and government issued photo identification.  Cash, checks, and foreign currency are not accepted.

 

CHECKS AND CHECK CASHING:

We do not accept checks (personal, business, or cashier).  We do not provide check cashing services.

 

DEBIT CARD HOLDERS

A debit card is not valid unless signed.  We will refuse an unsigned card.  The Cottages at Sandy Pines has no control over the policies of the debit card user’s bank and will not be held liable for any “insufficient funds” penalties or any other resulting fees or charges resulting from the room rental fees, taxes, or any charges set forth in these HOTEL POLICY/HOUSE RULES.  It is the debit card user’s responsibility to fully understand the manner in which the bank processes pre-authorizations and other charges to the debit card. 

 

DEPOSITS AND GUARANTEES:

Payment is due in full 60 days prior to the scheduled stay.

 

RATES:

All rates are quoted in United States currency, plus tax.  Rates may increase without notice.  Rates as advertised on The Cottages at Sandy Pines’ website or any other website or promotional material are subject to change at any time without notice and may increase or decrease at the hotel’s discretion.  Rates are based on standard room occupancy and are subject to availability.

 

RIGHT TO REFUSE SERVICE:

The Cottages at Sandy Pines is privately owned and operated.  We reserve the right to refuse service to anyone for any reason(s) that does not violate State or Federal laws.  The Cottages at Sandy Pines has a zero-tolerance policy in which we will refuse to admit or refuse service or accommodation in our hotel or may remove a person, without refund, those who refuses to abide by the reasonable standards and policies established in these HOTEL POLICY/HOUSE RULES, by the State of Indiana, or otherwise by the owners for the operation and management of The Cottages at Sandy Pines. The Cottages at Sandy Pines will refuse service or evict a guest: for refusal or failure to pay for accommodations, if a guest or the guest’s visitor is under the influence of alcohol, drugs, or any other intoxicating substance and acts in a disorderly fashion as to disturb the peace of other guests or is not in compliance with state liquor or drug laws; acts in a disorderly fashion as to disturb the peace of other guests; is unable to properly supervise their children at all times, seeks to use the hotel for an unlawful or immoral purpose; seeks to bring into the hotel an unlawfully possessed firearm; or something, including fireworks, an explosive or hazardous or toxic substance that is unlawful or dangerous to possess and that may be dangerous to other persons; destroys, damages, defaces, or threatens harm to The Cottages at Sandy Pines’ property or guests; causes or permits persons to exceed the maximum allowable occupancy of a room, refuses to abide by the reasonable standards or policies established by The Cottages at Sandy Pines for the operation and management of our facilities.

 

QUIET HOURS:

Quiet hours at The Cottages at Sandy Pines are 12:00 midnight to 7:00 a.m. If there is a disruptive guest, please contact facility staff immediately by phone at (219) 688-7934. Televisions, voices, or other devices must be kept at a respectful low level at all times.  Doors should be opened and closed quietly.  No congregating or running in halls/common areas.

 

VISITORS:

No visitors after 10:00 p.m. Visitors must be accompanied by the registered guest at all times.  Visitors are not allowed to use guest amenities.  The registered guest(s) is/are responsible for his/her visitor(s) at all times.

 

CANCELLATIONS:

The Cottages at Sandy Pines is not responsible for weather conditions, personal emergencies, or schedule changes.  Reservations must be cancelled not less than fourteen (14) days prior to guest’s scheduled arrival date in order to obtain a full refund.  Reservations cancelled between 3 and 13 days prior to guest’s scheduled arrival date may receive a refund of half (½) the amount of the room rate.  If reservations are cancelled within forty-eight (48) hours prior to the guest’s scheduled arrival date, the guest will incur the full charge of the stay plus applicable taxes.  No refunds will be made.

 

NO SHOW CHARGES:

Failure to check in on the scheduled arrival date for a reservation guaranteed with a credit card will not result in a refund.  The credit card on file will be charged the entire rate of the scheduled stay plus taxes.

 

Management ACCESS TO ROOMS:

To provide all of our guests with an exceptionally clean and safe hotel experience, we provide daily housekeeping.  The Housekeeping Staff is required to enter the room at subsequent times to clean the room, check for safety, and verify the condition of the room.  Management reserves the right to enter a room for reasonable purposes, such as an emergency, housekeeping, maintenance, verify that the room, its furnishings, and mechanical equipment are intact, or to address or prevent a violation of our HOTEL POLICY/HOUSE RULES. In the event of suspected illegal activity, management reserves the right to summon law enforcement to aid in eviction.  The management may grant law enforcement permission to search the room for any reason without the consent or knowledge of the guest.  Law enforcement will be granted immediate access to hotel property and rooms of evicted guests.

 

CHILDREN:

Well behaved children of all ages are welcomed.  Children aged 12 and under stay for free when sharing a room with one or more paying adult(s), using existing bedding.  Parents, guardians, or chaperones of children are personally and legally responsible for and must supervise them at all times.  For safety reasons, do not leave children unattended in guest rooms, common areas, or allow them to roam the hotel property unsupervised.

 

ADDITIONAL BEDDING:

No additional bedding is available.  Further, The Cottages at Sandy Pines does not supply cribs or cots.

 

MAXIMUM OCCUPANCY:

Room occupancy requirements are based on fire code/fire safety restrictions.  Standard Room maximum occupancy is 2 guests.  If the maximum number of guests allowed per room is exceeded, a charge of $225 for each additional person will be charged to the credit card on record.

 

ROOM CODES:

Room Codes are issued to the registered guest(s).  No room keys will be issued.  Codes are changed on a daily basis.  Room Codes will be issued via text messaging to the guest’s cell phone of record prior to the guest’s scheduled arrival time.  Messaging/data rates may apply.  The Cottages at Sandy Pines is not responsible for guest’s messaging/data charges.

 

HOUSEKEEPING/ROOM INSPECTION:

Housekeeping is provided daily between the hours of 10 a.m.- 4 p.m.  This is a 100 % NON-SMOKING hotel, including medical marijuana.  Rooms are cleaned and inspected daily and a detailed log is maintained on each room and linen.  Rooms are rented to guests in appropriate condition without any prohibited odor.  Housekeeping and the facility staff are trained and skilled in identifying the odors from prohibited items.  If our investigation concludes that a guest or a guest’s visitor has smoked in the guest’s room or common area, cooked, or brought a prohibited item into our facility, the guest will be charged as set forth in HOTEL POLICY/HOUSE RULES and may evicted without any refund.

 

LINEN CHANGING:

Our guests’ comfort is very important to us.  For guests staying multiples nights, bed linen is changed on a rotation schedule.  Used towels are exchanged for fresh towels daily.  If Housekeeping is unable to change a bed due to personal items left on a bed, a note will be left.  Housekeeping will be happy to change the bed linens and make the beds each day if all personal items are removed.  Please contact our facility staff if there are any additional questions or concerns.

 

LOST & FOUND POLICY:

The Cottages at Sandy Pines assumes no liability for lost, misplaced, stolen, or damaged valuables or belongings. If a guest discovers that the guest has left behind something of value, please call us immediately (219) 688-7934, and we will try to assist in locating the lost item.

 

FOUND ITEMS:

The Cottages at Sandy Pines is not responsible for any item left behind by a guest.  However, any item, with the exception of perishable items, underwear, and miscellaneous toiletries, left behind by our guests and found after departure by Housekeeping will be collected, logged in, and kept in a secure location for collection by the owner for up to thirty (30) days.  Reasonable effort will be made to notify the guest that an item has been found.  Perishable items, underwear, and miscellaneous toiletries are discarded.

 

RETURN:

We will be happy to return our guests’ lost item(s) by United States Postal Service upon request.  Sorry, no UPS or FED EX deliveries.  The credit card of record will be charged packaging and postage fees, plus a $25.00 handling fee.  The Cottages at Sandy Pines is not responsible for any item lost or misdirected during shipment by the United States Postal Service.  Please contact the USPS Customer Service Department at 1-800-275-8777.

 

UNCLAIMED ITEMS/NO CONTACT:

Lost & Found items are held for up to thirty (30) days while we attempt to contact the guest.  If guest contact information is incorrect or cell phone mailbox is full, and we are unable to contact the guest during the holding period, the unclaimed item(s) is/are: (a) if required by law, high value items not retrieved by the guest will be turned over to the Indiana Attorney General’s Unclaimed Property Division, OR (b) all other items are thrown away, given to local charitable organizations, or disposed of accordingly by The Cottages at Sandy Pines.

 

ALCOHOL POLICY:

Registered guests of legal age who choose to bring their own alcoholic beverages must consume those in their room.  Alcohol brought to the property is not allowed in common areas or on the grounds of the hotel, the Pavilion at Sandy Pines, or the Sandy Pines Golf Course except when purchased from those venues directly.  Alcohol consumed during special events served by a licensed caterer with permit to serve/sell alcohol is restricted to those 21 years old or older (valid photo identification required) and can only be consumed at that event venue.

 

FIREARMS, Explosives, Fireworks, AND WEAPONS:

The safety and security of our guests and staff are extremely important to us.  No firearms, explosives (including fireworks), or weapons of any kind are allowed at The Cottages at Sandy Pines facility, the adjacent Sandy Pines Golf Course, or the Pavilion at Sandy Pines.  Guests and their visitors who fail to abide by our policy may be asked to leave the premises/evicted, are subject to trespass, and may be subject to further legal action.  No refund will be issued.  Exempted from this policy are law enforcement officers and designated military personnel who are on-duty and required to carry firearms in the performance of their duties.  No exemption to this policy is allowed for private persons, even those licensed and permitted to carry a firearm openly or concealed under local, state, or federal law.  It is our policy to promptly turn over any firearms or explosives left on the property to the Jasper County Sheriff's Office or the DeMotte Police Department.

 

BICYCLES/HOVER BOARDS/ROLLER BLADES:

Bicycles, hover boards, and roller blades are not permitted in guest rooms or common areas.

 

IN CASE OF EMERGENCY OR FIRE:

Please call 911 in the event of a fire or other emergency.

 

FIRE SAFETY POLICY:

The Cottages at Sandy Pines is fully equipped with smoke detectors and sprinklers.  Any guests (or their visitors) found tampering with the fire/emergency system will be subject to a $1,000.00 charge in addition to the actual costs to repair all damage resulting from the tampering and all costs arising from the resetting of the fire/emergency system. 

 

NO IN-ROOM PARTY:

The Cottages at Sandy Pines enforces a No In-Room Party Policy to ensure we can protect the facility and our guests at all times.  No parties, loud disturbances and/or noise-nuisance are allowed or tolerated on these premises. In the event of a disturbance, one polite request (warning) will be given to reduce the noise.  If our request is not followed, the guest will be asked to leave the hotel without refund.   Registered guest(s) is/are responsible for all persons visiting.  Non-Registered visitors are only permitted until 10:00 P.M.  If found with visitors not listed as guests after 10:00 P.M. the guest’s stay will be considered a party.  Guests violating this rule may be ordered to vacate the premises without refund and may be accessed other fees as set forth in the HOTEL POLICY/HOUSE RULES.

 

Complimentary WiFi ACCESS:

Access to our WiFi is complimentary for our registered guests.  The hotel WiFi access code is subject to change without notice.  WiFi signals are subject to change without notice depending on the room’s location, the status of our WiFi-equipment, our internet connection, and interference from other local wireless signals.  The Cottages at Sandy Pines assumes no liability for guest use of our WiFi system.  The Cottages at Sandy Pines is not liable for any damages the guest may incur due to the internet connection being slow or unavailable for any reason throughout the duration of our guest’s stay.

 

ENFORCEMENT:

All staff is trained and required to respond to potential violations of our HOTEL POLICY/HOUSE RULES. Guests who refuse to abide by the reasonable standards and policies established by The Cottages at Sandy Pines for safety of all guests, staff, owners, property, and the operation and management of the hotel may be evicted with no refund. In addition to the room charge, the guest may be access other fees as set forth in the HOTEL POLICY/HOUSE RULES.

 

TERMS & CONDITIONS:

The Cottages at Sandy Pines makes its best efforts to ensure that all the information that appears on its website is accurate.  However, no warranty, expressed or implied, is given that the information provided on this website is error free.  The Cottages at Sandy Pines does not accept liability for any errors and/or omissions and reserves the right to change the information published at any time without notice.

ILLNESS AND EPIDEMICS:

The Cottages at Sandy Pines reserves the right to refuse accommodations to a guest arriving with a contagious disease.  In cases where sickness occurs during the stay, please notify the staff.  In the case of serious sickness, the guest or the guest’s visitor may be requested to receive appropriate health care from a nearby healthcare facility.  During epidemics, we are entitled to employ precautionary measures within our judgment or as recommended or required by local, state, and federal authorities.  Guests are required to abide by all masking and social distancing rules then in effect.  Guests may be charged a room cleaning fee as we deem appropriate under the circumstances.

 

INFESTATION:

The cleanliness of our rooms is extremely important to our guests.  Guests and their visitors shall not bring any infestation into the room or onto our premises.  The Cottages at Sandy Pines may charge the guest for any and all costs and expenses, including immediate or urgent response requirements and loss of room revenue, that we deem necessary to address the infestation.

 

PARKING AT OWN RISK:

Parking for registered guest(s) is free.  All vehicles are parked at the risk of the owner.  The Cottages at Sandy Pines does not provide parking lot security.  The Cottages at Sandy Pines shall not and does not assume liability or responsibility for any vehicle, occupants, or contents while operated or parked on the hotel property.  If a vehicle is left in the hotel parking lot after the guest has departed without the written consent of The Cottages at Sandy Pines, The Cottages at Sandy Pines reserves the right to have the vehicle towed at the owner’s expense, such charge will be made to the guest’s credit card of record.  No vehicle repairs shall be made on hotel premises.

 

DAMAGE AND/OR THEFT OF HOTEL PROPERTY:

Guests are fully liable for any damage howsoever caused (whether by the deliberate, negligent, or reckless act) to the room (s), hotel’s premises or property caused by the guest, the guest’s visitor(s), or any person in the guest’s party whether or not staying at The Cottages at Sandy Pines.  The Cottages at Sandy Pines reserves the right to retain the guest’s credit card details as presented at registration and charge the credit card such amounts as it shall in its sole discretion deem necessary or convenient to compensate or make good the cost or expenses incurred or suffered by The Cottages at Sandy Pines as a result of the damage(s).  Should this damage come to light after the guest has departed, we reserve the right and the guest hereby authorizes The Cottages at Sandy Pines to charge the guest’s credit card for any and all damage incurred to guest’s room or the Hotel property during the guest’s stay, including and without limitation for all property damage, missing or damaged items, smoking fee, cleaning fee, guest compensation, etc.  The Cottages at Sandy Pines makes every effort to rectify any damage internally prior to contracting specialist to make the repairs, and therefore will make every effort to keep any costs that the guest would incur to a minimum.

 

DAMAGE DISCOVERED AFTER CHECK-OUT:

Guest Rooms found with waste strewn around, in complete disorder, and/or “trashed” will be subject to maintenance deep cleaning fee, administration fees, bio-hazard or toxic waste fees, and/or third-party fees.

 

DAMAGE TO ROOM:

Damage to rooms, fixtures, furnishing and equipment including the removal of electronic equipment, towels, art work, etc. will be charge at 120% of full and new replacement value including, but not limited to any shipping and handling and installation charges. Any damage to hotel property, whether accidental or willful, is the responsibility of the registered guest for each particular room.  Any costs associated with repairs and/or replacement will be charged to the credit card of the registered guest.  In extreme cases, criminal charges and/or civil litigation will be pursued.

 

DAMAGE TO MATTRESSES AND BEDDING:

Damage to mattresses and linen including towels, mattress pads, sheets, bedspreads, blankets resulting from the use of body oils, make-up, shoe-polish, etc. will result in a charge for the special cleaning, repair, or replacement of the damaged article(s).

 

DAMAGE OR TAMPERING WITH FIRE DETECTION SYSTEMS/FIRE-FIGHTING EQUIPMENT:

The Cottages at Sandy Pines reserves the right to take action against any guest or visitor found to have tampered or interfered with any detection equipment throughout the hotel, including detector heads in public areas, guest rooms, security cameras, break glass points and fire extinguishers.  Guests or visitors found to have tampered with any fire detection or fire-fighting equipment will be charged with any and all costs incurred by the hotel due to their actions and will be evicted from the hotel without refund.  Depending on the severity of the guest actions, law enforcement may become involved at the hotel’s discretion.  Should the fact that fire-fighting or detection equipment had been tampered with come to light after the guest has departed, we reserve the right and the guest hereby authorizes us to charge the guest’s credit card for any damage incurred to the guest’s room or the Hotel property during the guest’s stay, including and without limitation for all property damage, missing or damaged items, smoking fee, cleaning fee, guest compensation, etc.

NO ANIMALS ALLOWED:

The Cottages at Sandy Pines has a strict no animal policy.  Pets and comfort animals of any type are not allowed for any reason.  Exempted from this policy are Americans with Disabilities Act (ADA) service animals which are individually trained to provide assistance to a guest with a disability. A service animal is not a pet.  Comfort animals are not service animals under the law.  A service animal must be under the control of its handler. Under the ADA, service animals must be harnessed, leashed, or tethered, unless the individual’s disability prevents using these devices or these devices interfere with the service animal's safe, effective performance of tasks. In that case, the individual must maintain control of the animal through voice, signal, or other effective controls.  The guest is strictly liable for any and all damage caused by the service animal, including a $250 cleaning charge associated with a deep cleaning required if the ADA service animal soils the room, including but not limited to the carpets, towels, and bedding.

CHANGES OR MODIFICATION TO THE HOTEL POLICY/HOUSE RULES:

The Cottages at Sandy Pines reserves the right to amend, modify, change, cancel, vary, or add to these HOTEL POLICY/HOUSE RULES or the arrangements and content featured on our website at any time without prior notice.  Please check our website regularly for updates to HOTEL POLICY/HOUSE RULES. Any modification to these HOTEL POLICY/HOUSE RULES that occurs before a guest’s departure is considered a part of the guest’s reservations agreement with us. A copy of these HOTEL POLICY/HOUSE RULES is located on our website and available from our staff upon request.

No Residency or Tenancy

HOTEL POLICY/HOUSE RULES do not in any way establish residence or tenancy of any kind in the guest, its visitors, or any person claiming under or through the guest.  The use of the facilities and room(s) of The Cottages at Sandy Pines is for short terms guest stays.

LIMITIATION OF LIABILITY including WAIVER & INDEMNIFICATION

The Cottages at Sandy Pines takes utmost care with the provision of goods and services it provides under Reservation Agreement/Contract.  However, in the event The Cottages at Sandy Pines is unable to perform this contract due to fire or other casualty, strike, act of God, act of terrorism, or any other cause beyond the control of the parties, then The Cottages at Sandy Pines shall return to the Customer all deposits made under the Reservation Agreement/Contract and shall have no further liability with respect to the contract.  In the event that The Cottages at Sandy Pines fails to perform for any other reason, The Cottages at Sandy Pines shall not be liable for any amount in excess of the retail value of the goods and services provided under the Reservation Agreement/Contract, and in no event shall The Cottages at Sandy Pines be liable for any amount in excess of the amount actually paid to The Cottages at Sandy Pines by the Guest(s).  The Guest(s) agrees to indemnify and hold harmless The Cottages at Sandy Pines, its employees, owners, assistants, representatives and agents from any and all claims, including attorney fees and costs, made by persons and/or entities claiming by or through the Guest(s), or by virtue of the Reservation Agreement/Contract and related in any way, directly or indirectly to the guest’s stay at The Cottages at Sandy Pines. by way of example and not as a limitation, this indemnification includes: claims for negligence, gross negligence, personal injury, property damage, and wrongful death.

Governing law/Jurisdiction

This contract shall be governed by and construed in accordance with the laws of the State of Indiana, both procedural and substantive. The parties agree that they irrevocably submit to the exclusive jurisdiction of the State courts located in Jasper County, Indiana, for the purposes of any actions or proceedings arising out of or relating to this Agreement or the subject matter hereof. The parties waive and agree not to assert, by way of motion, as a defense or otherwise, in any such action, or proceedings, any claim or defense that they are not subject to the personal jurisdiction of such courts, and/or that the action or proceeding is brought in an inconvenient forum.
